Washington, DC (PRWEB) February 04, 2016 A new law could spur many providers to move to two-sided risk, predicts Leavitt Partners LLC Director of Research David Muhlestein in the Februrary 2016 issue of AISs Value-Based Care News (VBC). According to VBC, the Medicare Access and CHIP Reauthorization Act of 2015 (MACRA) repealed the Medicare Sustainable Growth Rate (SGR) formula which was unpopular with providers and replaced it with two separate types of incentive payments: the Alternative Payment Model and the Merit-Based Incentive Program. Physicians who participate in Alternative Payment Models could get a 5% annual bonus from Medicare, according to VBC, but they would have to accept downside risk for at least 25% of their payments. That means that they would have to share in losses if a patients care cost more than expected, as well as share in savings if care cost less than expected. The alternative, the Merit-Based Incentive Program, offers bonuses based on quality, use of resources, use of electronic health records and practice improvement, and thus is much more complex. They also have to wear an ankle bracelet that that continuously monitors their skin for alcohol. The bracelet then wirelesslytransmits those results to a monitoring center.In addition they have to wear skin patches that can be checked for drug usage. If someone fails any of these test they are immediately taken into custody. Ed Nolan,Director of Operations at Northwood Health Systems says there are several advantages to the program,”It helps prevent against fatalities,helps protect against repeat driving under the influence,helps individuals avoid jail terms and cuts cost by doing that. John Chase, a Santa Clara County deputy district attorney, told this newspaper that the complaint, submitted in early December, was reviewed and ultimately dropped on Dec. 15 due to “insufficient evidence to prove the crime occurred.” Although he would not fully discuss the case, Chase did say: “There was an allegation that she illegally recorded a conversation in May of this year, but we’ve declined to prosecute the case (because) we thought there was some reasonable doubt.” This week, Milpitas City Manager Tom Williams said Valdez’s actions occurred during a meeting involving a personnel matter in which retired Milpitas firefighter and former fire union president Steve King issued his own workplace complaint against Valdez — one that involved his compensation while working for the city. That case was apparently dropped as neither King nor Valdez works for the city any longer. “It was found that she was recording the meeting,” Williams said, adding that Valdez secretly used her smart phone’s audio recorder to do so. “I was in the meeting and one other person was in the meeting.” Moreover, Williams claimed Valdez’s actions were in clear violation of California’s penal code, which is why Milpitas police investigated and filed the complaint with the district attorney. Kielian, who has been in private practice since 1990, was picked from a pool of 14 people which included current court system employees and external candidates, including some from outside the county, Kurt Sangmeister, court administrator, said. “Mr. Kielian has literally dedicated his career to providing effective defense and protecting the rights of the accused,” Schoenstedt said in the release. Kielian was an assistant public defender on a full-time basis from 1976 through 1978, then worked part-time for the office from 1979 until 1988 while he was also a partner in the firm Gray, Kleczek & Kielian. “I thought it was a good fit for me,” Kielian said of his decision to apply for the job. “I will be able to use my experience to mentor the younger attorneys in the Public Defender’s Office.” A search for a new defender began in late October after Astrella said he would leave the job.
